The first decision: a closer look at Québec’s ISP-blocking legislation

On 12 November 2015, Québec’s Finance Minister tabled an Act, mainly respecting the implementation of certain provisions of the Budget Speech (’the Budget’) of 26 March 2015. Article 12 of the Budget (‘the Article’) concerned illegal online gaming sites and the proposed means of blocking those sites in Québec. The explanatory notes to the Article stated that in order to monitor online gambling, the provincial Consumer Protection Act 1978 (‘CPA’) was being amended to require internet service providers (‘ISP’) to block access to gambling websites entered on a list which would be compiled by Québec’s lottery operator, Loto-Québec. It was intended that Loto-Québec would monitor the compliance of ISPs with the new law and report any failures in order to comply with Québec’s gaming regulator (‘RACJ’). The Québec legislature assented to the Budget and on 18 May 2016, with certain exceptions, it came into force.
